The review must consider: the status of regional cities; land that has been strategically identified as being suitable for urban development, even if outside of the Sydney Metropolitan area and/or not currently zoned urban; and clearing that is subject to an approval under the Environmental Planning and Assessment Act.

The State Plan should include a new target that clearly states the number of zoned and serviced lots ready for development and a timeframe in which these lots will be produced. Its also important that the NSW Government measure its performance based on actual outcomes on the ground.

The new State Plan must include real and measurable targets for timely assessments of rezonings and the finalisation of standard instrument compliant local environmental plans. The State must also take the lead and actually articulate the level of population growth around centres and corridors and specify a timeframe. Finally, the wording of the State Plan on local council infrastructure contributions should reflect the governments public commitment.

The proposed legislation sets a dangerous precedent because it empowers the government to make regulations willy-nilly that may profoundly affect the property rights of NSW citizens.

We have grave concerns with the use of section 94A plans to gradually increase taxes imposed on new development. Furthermore the Urban Taskforce must record its alarm with the disclosure by Council that the existing plan will not meet legislative requirements outlined in the Environmental Planning and Assessment Act 1979.

These two documents, as currently conceived, will further complicate the development assessment process. They will increase the emphasis on box ticking, at the expense of a genuine evaluation of the individual merit of development applications.
