The existing process to secure the "biodiversity certification" of environmental planning instruments is difficult. There is little incentive for councils to participate. The Threatened Species Conservation Amendment (Biodiversity Certification) Bill 2010 addresses this problem generally by providing a clearer process for the operation of the "improve or maintain" test. It allows decisions to take place in accordance with clearly articulated rules.

We cannot support the bill unless these issues are resolved and a full legal draft of the subordinate legislation has been prepared and publicly exhibited. There is too little information on the public record to give industry clarity as to the government's intentions.

Off-site linkage infrastructure ("backhaul") should be funded by all network users; not property developers. Optic fibre technology is desirable, but not essential. Legislation must make allowance for alternative technology and innovation. Legislation should remain focused on making development projects fibre ready/capable. The requirement to install FTTP should be linked to the presence of linkage optic fibre infrastructure; not to the size of an urban development. The 1 July 2010 commencement is not realistic.

The latest version of the bill contains provisions that will weaken property rights and increase investment uncertainty. Amendments to the bill can rectify these issues, without compromising on the governments public policy objectives.
